One-Day national seminar on increasing pendency of cases in the courts: The need for alternative dispute resolution and a Uniform Civil Code
The KAMKUS college of law, Ghaziabad, is all set to host a crucial one-day national seminar on October 14, 2023. Challenges Faced by the Judicial System
India's citizens trust the judicial system as a beacon of justice. However, the
extensive delays and the backlog of cases cast a shadow of doubt over the
efficacy of the system. Article 21 of the Constitution, which guarantees the
fundamental right to life and liberty, is threatened by this issue. With over 5
crore cases pending in Indian courts, it is essential to address this problem.
The increasing number of pending cases reflects a lack of respect for the
judicial system and the governing laws.
The Role of Alternative Dispute Resolution
The Alternative Dispute Resolution (ADR) mechanism can play a pivotal role in
tackling the challenges of case backlog and delayed justice. Mediation,
negotiation, and harmonious settlements are essential tools in this process.
Legal professionals, including law students, advocates, judicial officers, and
judges, must understand human behavior and the significance of relationships to
ensure the success of ADR.
The Need for a Uniform Civil Code (UCC)
Families are the cornerstone of human civilization, fostering affection,
respect, love, gratitude, pride, and belongingness. However, the erosion of
trust within families and society is leading to a rise in disputes. Materialism
and money have eclipsed the importance of relationships, resulting in
increasing abuse and crime within families. Divorce and property disputes have
led to a surge in court cases. International research indicates that the
breakdown of families is a primary cause of crime. Consequently, the need for a
single law governing all families has garnered national attention.
Focusing on Family Education
Promoting ethical behavior within families, instilling human values,
understanding relationships, and evaluating mutual rights are vital components
of judicial education. Judicial education must emphasize values, character,
morality, loyalty to the social and national system, and a humane mindset. This
should be a compulsory part of the training and teaching for law students,
judicial staff, and judges.
The national seminar on October 14, 2023, is a critical platform for discussing these issues and finding solutions to alleviate the burden on India's judicial system.
